Mud on the Road

As highway authority Denbighshire County Council is responsible for the highway and we have a statutory duty to ensure safe passage for all users.


Depositing mud/debris on the highway is an offence under Section 148 of the Highway Act. Where the offender can be identified they can be prosecuted by either the police or the highway authority.


Mud and other debris can be dragged out onto the road as a result of farming activities, construction sites and other events such as gymkhanas’ Caravan rallies or shows especially if they coincide with periods of rain. Persons responsible for any of the above should make provision for cleaning the road, and providing warning signs. Warning signs should be triangular “Slippery Road” signs, any home made, hand painted signs are not legal and they in turn may constitute an unauthorized obstruction.


Under Section 149 of the Highways Act 980, the County Council has a duty to clean the road and has the power to recover the costs incurred from the persons responsible.
